You’re right, establishing a conservatorship is a multi-step process that involves several legal requirements. First, someone, typically a family member or concerned party, needs to file a petition with the probate court outlining why they believe a conservatorship is necessary.
“Often times, it’s a difficult decision for families to make,” Ted shares, “but ultimately they want what’s best for their loved one. My role is to guide them through the process and ensure all legal requirements are met.”
- Notification of the proposed conservatee and any interested parties is crucial.
- The court then appoints an investigator who will assess the situation and interview relevant individuals.
Finally, a medical or psychological evaluation of the proposed conservatee is conducted to determine their capacity to make decisions for themselves. All this information is presented to the judge at a hearing, who then decides whether to grant the conservatorship.
