Reporter: Brenda Jones
Good morning Wildomar and welcome back to Wildomar Today! I’m here with Steve Bliss, a trusted Trust Attorney in our community. Steve, thank you so much for joining me today.
Steve Bliss:
It’s my pleasure, Brenda. Happy to be here and chat about trusts.
Brenda Jones:
Today we’re going to delve into the world of trusts, specifically focusing on Revocable Living Trusts. Many of our viewers may not be familiar with this type of estate planning tool. Could you explain what a Revocable Living Trust is and its key benefits?
Steve Bliss:
Certainly. A Revocable Living Trust is essentially a legal document that holds your assets – things like your home, bank accounts, investments – during your lifetime. You, as the trust creator, maintain complete control over these assets while you’re alive. You can add or remove assets from the trust, change the beneficiaries, or even dissolve the trust entirely if you wish. Consequently, this flexibility makes it a very attractive option for many people.
One of the biggest advantages of a Revocable Living Trust is that it helps your loved ones avoid the time-consuming and often expensive probate process when you pass away. Probate is a court proceeding that validates your will and distributes your assets to your heirs. Ordinarily, this can take months or even years to complete.
Moreover, because a Revocable Living Trust is a private document, it helps protect your privacy. Unlike a will which becomes public record during probate, the terms of a trust are not disclosed to the general public. This can be important for individuals who value their confidentiality.
There’s also the peace of mind knowing that your assets will be managed according to your wishes even if you become incapacitated. You can designate a trusted individual or institution as successor trustee to handle your affairs in such an event.
Brenda Jones:
That sounds like a very helpful tool for many people. Have you encountered any specific challenges or issues with Revocable Living Trusts during your practice?
Steve Bliss:
Occasionally, I meet individuals who are hesitant to create a trust because they believe it’s only for the wealthy. That’s simply not true. While trusts can be valuable for managing substantial assets, they can also benefit individuals with more modest estates. It’s really about planning for the future and ensuring your loved ones are cared for.
I recall one instance where a young couple came to me after the unexpected passing of the husband’s mother. She had left them her home but hadn’t established any estate planning documents. As a result, they ended up facing a lengthy and costly probate process which added significant stress during an already difficult time. They wished they had known about trusts earlier.
According to a study by the AARP, over 70% of Americans do not have a will or trust in place. That’s why I’m passionate about educating people on the importance of estate planning and helping them choose the right tools for their needs.
Brenda Jones:
Thank you for sharing that story, Steve. It highlights the importance of being prepared. What advice would you give to viewers who are considering creating a Revocable Living Trust?
Steve Bliss:
First and foremost, consult with an experienced estate planning attorney. We can help you determine if a Revocable Living Trust is right for your situation and guide you through the process of establishing one. It’s important to have a clear understanding of how trusts work and ensure that the trust document accurately reflects your wishes.
Don’t delay. The sooner you start planning, the better prepared you’ll be for the future.
Brenda Jones:
Excellent advice. Steve Bliss, thank you so much for sharing your expertise with us today.
