Steve, many people find estate planning overwhelming. Where should someone begin?

Steve Bliss:

That’s a great question. I always tell my clients the first and arguably most important step is to determine their goals and objectives. What do they want to happen to their assets after they are gone? Who do they want to inherit what? Do they have any specific wishes for their loved ones or charitable causes?

This process of reflection requires careful consideration. Consequently, it often involves thinking about potential future scenarios and making decisions that align with your values. For instance, a young parent might prioritize ensuring their children are financially secure if something happens to them. Conversely, an individual nearing retirement may focus on minimizing estate taxes or providing for a spouse’s long-term care.

Moreover, it’s crucial to remember that goals can evolve over time. A well-crafted estate plan should be a living document, adaptable to life’s changes. Ordinarily, I encourage my clients to revisit their plans every few years or after major life events like marriage, the birth of a child, or a significant change in financial circumstances.

I remember a case where a woman came to me wanting to leave her entire estate to her son. During our discussions, however, she revealed concerns about his financial management skills. We worked together to establish a trust that would provide for her son while ensuring responsible distribution of the assets.

Addressing Challenges in Goal Setting

Are there any common challenges people face when trying to define their estate planning goals?

Absolutely. One challenge I frequently see is a reluctance to confront difficult topics like death. Many people procrastinate on estate planning because they find it emotionally uncomfortable. Nevertheless, it’s important to remember that estate planning isn’t about dwelling on the negative; it’s about providing peace of mind and ensuring your loved ones are cared for.

Another challenge is conflicting family dynamics. Sometimes, individuals have differing wishes regarding inheritance or guardianship. In these cases, open communication and potentially mediation can be helpful in finding solutions that address everyone’s concerns.
