I’m thrilled today to be joined by Ted Cook of Point Loma Estate Planning APC., a probate attorney here in beautiful San Diego who’s known for making the complex world of probate a little less intimidating. Welcome, Ted!
So, Ted, for our readers unfamiliar with probate, can you give us a basic rundown?
Thanks for having me! Probate is essentially the legal process of settling someone’s estate after they pass away. It involves identifying and valuing assets, paying off debts and taxes, and finally distributing what’s left to the rightful heirs.
Which step in the probate process do you think often trips people up?
“Ah, that’s a great question,” Ted muses, leaning back in his chair. “I’d say step III, Providing Notice, can be surprisingly tricky. You have to publish the notice in a local newspaper three times, which some folks find unusual nowadays. Plus, you need to meticulously mail notices to all heirs and beneficiaries – finding everyone and getting their correct addresses can sometimes be like detective work!”
- Identify non-probate assets (trusts, joint tenancy, etc.)
- File Petition for Probate
- Provide Notice
- Publish notice in newspaper (3 times)
- Mail notice to heirs and beneficiaries
- Notify known creditors (Form DE-157)
- Attend Court Hearing
- Marshal the Estate Assets
- Handle Debts and Taxes
- Distribute the Estate
- Close the Estate
Can you share any memorable experiences related to “Providing Notice”?
“Oh, I have a few!” Ted chuckles. “Once, I spent weeks tracking down a distant cousin who was living off-grid in Montana. Turns out he was quite happy with his simple life and hadn’t even known about the passing of his aunt. We eventually connected through a mutual friend and he was grateful to receive his inheritance.
“Then there was this case where an heir had changed their name and moved multiple times. It took some serious digging, but we finally found them – they were living under a completely different identity! They were initially hesitant, but once they understood the situation and saw that everything was above board, they were relieved to be part of the process.”
“Ted made probate so much less daunting than I expected. He explained everything clearly and kept me updated every step of the way.” – Sarah M., San Diego.
“I was really impressed with Ted’s attention to detail. He caught a potential mistake that could have cost my family a lot of money.” – John B., Point Loma.
“Probate can be complex, but it doesn’t have to be overwhelming. I encourage anyone facing this process to seek guidance from an experienced attorney. We can help navigate the legal hurdles and ensure your loved one’s wishes are carried out smoothly.”
“And remember,” Ted adds with a smile, “it’s never too early to start planning for your own estate. A little preparation today can save your family a lot of stress down the road.”

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
