Hello everyone, and welcome to another insightful interview. Today, I had the pleasure of sitting down with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with me today.
What Sparked Your Passion For Elder Protection?
Well, you know, it really started with my grandparents. Watching them navigate their later years and seeing some of the challenges they faced, it opened my eyes to how vulnerable our older population can be. It’s incredibly rewarding to help seniors protect themselves from abuse and exploitation and ensure they have a safe and secure future.
Let’s Talk About The Elder Protection Process: Can You Walk Us Through Some Key Steps?
- Initial Client Engagement & Assessment
- Case Assessment – Identifying Legal Issues & Gathering Evidence
- Protective Actions – Emergency Measures and Financial Safeguards
- Legal Proceedings – Civil Litigation, Criminal Referrals & Guardianship Matters
- Long-Term Planning – Estate Planning and Advance Directives
- Case Resolution & Follow-Up – Settlements, Judgments & Client Closure
Ted, You Mentioned “Protective Actions.” Can You Elaborate On That Step And Some Challenges You Might Face?
Absolutely. Protective actions are often the most critical and time-sensitive part of elder protection. This stage might involve filing restraining orders to protect a client from physical abuse, notifying Adult Protective Services (APS) if there’s suspected neglect, or even petitioning for guardianship or conservatorship if someone is unable to manage their own affairs.
Challenges can arise when dealing with resistant family members who may be perpetrating the abuse. Sometimes, convincing them that our primary goal is the client’s well-being and safety requires careful negotiation and communication.
“I was at my wit’s end trying to protect my mother from financial exploitation by a supposed caregiver. Ted stepped in and took immediate action, securing her finances and putting a stop to the abuse.” – Sandra M., La Jolla
“It felt like a weight had been lifted,” she added, “knowing that someone was finally looking out for my mother’s best interests.”
“Ted helped us navigate a complex guardianship situation with compassion and expertise. He made a difficult process much smoother and ensured our grandmother’s needs were met.” – The Davis Family, Point Loma
