A Chat With Ted Cook: Protecting Our Most Vulnerable

Today we’re joined by Ted Cook, an elder protection attorney based right here in beautiful Point Loma. Ted, thanks for taking the time to chat with us today.

What Inspired You to Focus on Elder Protection?

“Well, it all started when I saw firsthand how easily vulnerable seniors could be taken advantage of,” Ted explains. “There’s a real need for someone to advocate for them and ensure their rights are protected.” He goes on to describe a particularly touching case early in his career where he helped an elderly woman reclaim her stolen life savings. “That experience solidified my passion for this work,” Ted says with a smile.

Can You Walk Us Through the Steps Involved in Protecting an Elder?

Ted pulls out a diagram outlining the process, which breaks down into six key stages: Initial Client Engagement, Case Assessment, Protective Actions, Legal Proceedings, Long-Term Planning, and finally, Case Resolution & Follow-Up.

Let’s Dive Into “Protective Actions” – What Does That Entail?

“This stage is all about taking immediate steps to safeguard the elder,” Ted explains. “Depending on the situation, we might need to file for a restraining order against an abuser, alert Adult Protective Services, or even petition the court for guardianship if the individual lacks capacity to make sound decisions.”

He goes on to describe the process in detail:

• “Emergency Legal Remedies: Our first priority is always the elder’s safety. We may need to file restraining orders against abusers, report suspected abuse to Adult Protective Services (APS), or seek guardianship/conservatorship if the individual lacks capacity.
• “Financial Protections: We work to secure their financial well-being by freezing accounts, revoking powers of attorney if necessary, and preventing unauthorized transfers.
• “Healthcare and Living Arrangements: This often involves facilitating a move to a safer care facility and coordinating with medical professionals for evaluations and treatment plans.

“It’s crucial to act swiftly and decisively during this stage,” Ted emphasizes, “because every minute counts when someone’s safety and well-being are at risk.”

Have You Ever Encountered Any Challenges During This Stage?

Ted recounts a case involving an elderly woman who was being financially exploited by her own caregiver. “We had to act quickly to prevent further losses,” he says. “It involved some creative legal maneuvering and working closely with law enforcement, but ultimately we were able to secure her assets and prosecute the abuser.”
