Steve Bliss: Estate Planning Attorney
It’s my pleasure, Barbara. I’m always happy to discuss the importance of estate planning.
Choosing an Executor or Trustee
Barbara Jenkins
One crucial step in the estate planning process is selecting an executor or trustee. Can you elaborate on why this decision is so important?
Steve Bliss
Absolutely. The executor or trustee plays a pivotal role in carrying out your wishes after you’re gone. They’ll be responsible for managing your assets, paying debts and taxes, and distributing your property to your beneficiaries according to your will or trust.
Consequently, it’s essential to choose someone trustworthy, responsible, and capable of handling these complex tasks. This individual should understand your financial affairs, have good organizational skills, and be willing to take on the responsibility.
Moreover, consider factors such as their age, health, and location. You want someone who will be able to fulfill this role for the foreseeable future.
I often recommend discussing your wishes with potential candidates beforehand. This allows them to understand their responsibilities and make an informed decision about whether they’re comfortable taking on the role.
In my experience, choosing a family member or close friend can be a good option, but it’s important to ensure they have the necessary skills and are prepared for the emotional weight of this responsibility.
Sometimes families encounter disagreements about who should serve as executor. It’s crucial to remember that open communication and clear expectations can go a long way in preventing future conflicts. I always encourage clients to consider naming backup executors in case their primary choice is unable or unwilling to serve.

Have you ever encountered situations where selecting an executor presented unique challenges?
Steve Bliss
I recall one instance where a client had a large, complex estate and struggled to choose between two siblings who both expressed interest in serving as executor.
After careful consideration and open communication with the family, we decided to appoint both siblings as co-executors. This allowed them to share the responsibility and leverage their respective strengths. While it required a bit more coordination, ultimately, it proved to be a successful solution that honored the client’s wishes and preserved family harmony.
In another case, a client had concerns about their chosen executor’s financial literacy. We worked together to develop a plan where they would receive guidance from a financial advisor during the estate administration process. This ensured that the executor felt confident and supported in fulfilling their duties.

Those are certainly valuable insights, Steve. What advice would you give to individuals who are unsure about how to proceed with selecting an executor or trustee?
Steve Bliss
My best advice is to consult with a qualified estate planning attorney. We can help you assess your individual needs and circumstances, discuss the pros and cons of different options, and guide you through the process of making this important decision.
Remember that estate planning is not a one-size-fits-all endeavor. What works for one person may not be suitable for another. Having a legal professional by your side can ensure that your plan reflects your unique wishes and protects the interests of your loved ones.
