Estate Planning with Steve Bliss

Introduction

Hello San Diego and welcome back to Legal Matters. I’m your host, Riley Jones. Today we are joined by estate planning expert Steve Bliss of San Diego Probate Law. Steve, thank you for joining us.

Selecting an Executor or Trustee: A Crucial Decision

Riley: Steve, let’s talk about the process of selecting an executor or trustee. This is a crucial role, responsible for managing someone’s estate after they pass away. Can you elaborate on this step?

Steve Bliss: Absolutely. Choosing the right person to handle your affairs after you’re gone is vital. Consequently, you want someone trustworthy, organized, and capable of making sound financial decisions. This individual will be responsible for paying debts, filing taxes, distributing assets according to your wishes, and navigating any legal complexities that may arise.

Moreover, consider the person’s age and health. You need someone who is likely to be around when you pass away and has the mental and physical capacity to handle the responsibilities. Ordinarily, people choose a family member, close friend, or even a professional executor like a financial advisor or attorney.

A common misconception is that the oldest child automatically makes the best executor. However, this isn’t always true. You need to select someone who has the time, skills, and emotional maturity to handle this sensitive role effectively.

There was a case I handled where a family chose the eldest son as executor, even though he lived across the country and had a very demanding job. Ultimately, he felt overwhelmed and struggled to manage everything remotely. In retrospect, they realized a local sibling with more time and flexibility would have been a better fit.

The Importance of Communication

Steve Bliss: I always encourage open communication with potential executors. Discuss your wishes openly and honestly. Explain the responsibilities involved, and make sure they understand and are comfortable taking on the role. Remember, it’s a big responsibility and shouldn’t be taken lightly.
