Certainly. Marshaling estate assets is a crucial step in the probate process where we meticulously identify, inventory, and value all of the deceased person’s assets.

This includes everything from bank accounts and real estate to personal property like vehicles and jewelry. We work closely with the executor or administrator, who is appointed by the court to oversee the estate, to ensure a thorough and accurate accounting of all possessions. Consequently, this step lays the groundwork for handling debts, paying taxes, and ultimately distributing assets according to the deceased’s wishes.

Ordinarily, this involves obtaining documentation such as bank statements, property deeds, investment account records, and insurance policies. It can sometimes be a complex process, especially if the deceased individual had numerous assets or investments spread across different institutions.

Moreover, we must determine the fair market value of each asset at the time of death. This often involves appraisals for real estate, vehicles, or valuable artwork. Accurate valuation is essential for tax purposes and to ensure a fair distribution of assets among heirs.

I recall one case where a client’s grandfather had accumulated a significant collection of antique coins over his lifetime. The executor was unaware of their existence until we began the process of marshaling assets. Discovering this hidden treasure not only added considerable value to the estate but also revealed a fascinating aspect of the grandfather’s life.

It highlighted for me how important it is to approach each case with thoroughness and empathy, as unexpected discoveries can sometimes emerge during the probate process.
