Special Needs Trusts: Protecting Loved Ones
Steve, many people are unfamiliar with the variety of trusts available in estate planning. Could you shed some light on one type of trust that holds particular significance?
Certainly. One type of trust that I find incredibly impactful is the Special Needs Trust (SNT). This type of trust is specifically designed to benefit individuals with disabilities without jeopardizing their eligibility for vital government benefits like Supplemental Security Income (SSI) or Medi-Cal.
Now, there are two primary types of SNTs: first-party and third-party. A first-party SNT is funded using assets belonging to the beneficiary with special needs. Conversely, a third-party SNT is established and funded by family members, friends, or other well-wishers.
The beauty of an SNT lies in its ability to provide supplemental support for individuals with disabilities while ensuring they can continue receiving essential government assistance. Imagine a young adult with autism who receives SSI benefits but desires greater independence. An SNT could be funded to cover expenses like specialized therapies, adaptive equipment, or even recreational activities, ultimately enhancing their quality of life without affecting their eligibility for crucial government programs.
The importance of SNTs cannot be overstated. According to the National Disability Rights Network, over 54 million Americans have a disability. Consequently, many families face the daunting challenge of balancing their loved one’s needs with the complexities of government benefits.
Over the years, I’ve had the privilege of working with countless families who were navigating this very situation. One case that particularly stands out involved a single mother whose son had Down syndrome. She was understandably overwhelmed by the prospect of providing for her son’s future while ensuring he continued to receive critical support. We established a third-party SNT, and seeing the relief wash over her face as we secured her son’s well-being was truly heartwarming.
